it depends on the situation. Is that a state where it has to go before a judge? I have a friend in NY where he has not made a mortgage payment since 2008!! The current note holder has tried to foreclose several times in court and every time it was thrown out because they could not show the chain over ownership or that they actually held the deed. He originally financed through country wide. Since then it has been sold several time with one of the holders going BK. The trustee "looking out for creditors" got the judge to agree with destroying original documents because they were backed up electronically and this saved tens of thousand of dollars by eliminating storage costs. Well now foreclosure judges wanna see originals. What is your situation?
