Put in two weeks notice and was told to leave immediately. Unemployment ?

I have been a salesman for a Toyota dealership in Florida. I got a job offer at the biggest Lexus dealership in the world so of course I took it. I went in to put in my two weeks notice and I was asked to leave immediately which means I will be out of work for 2 weeks. Do I qualify for unemployment? This seems to be common practice in the car business.

My wife, who works for corporate America, says you quit. When you give two weeks, the company has the option. They also have the option to pay those two weeks.
So, just do double splits and take naps and make food at home in the meantime....

Get a copy of your employment agreement. At my firm if you put in your two weeks and they tell you to not come back, they still have to pay you the two weeks.

However, I'm a full-time salary. I would be interested to know if OP is full-time, hourly, etc.

I assume you were in sales ? When i was in sales i couldn't draw unemployment when i got out of it because i didn't pay in

If in sales they told you to go so you wouldn't take customers/information , sounds pretty standard in that type of business. I wouldnt bother with unemployment if your going right to another job. More time and effort spent than what you will get in return IMHO

Sales people in dealers usually work only off commissions at least in Florida.unless things have changed

I cant start at Lexus till the 13th because that is when their sales training is starting. I was commission only in sales. I knew this would happen because they have done the same thing to other guys in the business. They are worried Im going to take their leads for a $200 a month corolla and talk them into getting a $500 a month Lexus :banghead: Its not even about the money to be honest. I just want to make sure since Im sitting on my ass till the 12th I should get some pay for it since I was willing to work but THEY didn't want me to.

I could have been an asshole and worked till the 12th and then disappeared on the 13th but I wanted to do the right thing and give them a notice. Looks like you get fucked in the ass for doing the right thing these days

Correct, state law could vary, but you ended your employment by giving notice. They have the option to waive your two week period. You do not qualify for unemployment. This is not my area of practice, but this would be my thought firing from the hip based on my state laws.

OP...... in Florida the max you get in unemployment is $275 per week.that's before taxes...you can choose for them to take the taxes out of the $275.or you can get the full $275 but at the end off the year you have to pay the taxes
When you file your income tax.

Now that being said if your employer denies the claim.then you have to appeal it.which means someone from unemployment will have a 3-way call.. you, your employer, and unemployment office.and all 3 discuss it over in the call.unemployment rep makes the final decision.and don't miss the call or you automatically loose the case.it happens to me.I answered the phone on the last ring but it was too late.I called the guy back with in seconds.and he wouldn't even take my call.he told the person on the phone to tell me it was too late I lost the case.I told them he just called me not even a second ago how can it be too late.but the answer was still no... lol they will send you a letter telling you the date and time off the call and they are right on the money with the time too.anyways by the time all this is done.you would be at your new job already lol

When I was a business account manager at Verizon Wireless, it had in their agreement that if you were leaving them to go to a competitor, that they had the legal right to end your employment on the spot instead of waiting two weeks, however, they would pay you those two weeks, from what I remember anyway. The same rules applied to the publishing company I was working for.

My position was base plus commission, so I don't know how it is for commission only companies, nor if the laws vary from state to state, MD is an "at will" state btw, not sure if FL is.

Sorry to hear what happened...but if you KNEW it would happen, it's your own fault. Especially if you had/have to support a family.....fuck the dealership and you disappear after the final day-instead of having them screw you.

spend the next 2 weeks studying everything lexus, every model, every feature, the competitor (will be a bit different than competitors to a corolla). Why is a lexus es better than say a benz e350? Don`t waste your time with unemployment. There is waiting period and you can get denied any way. To get benefits you must answer "are you actively looking for work", "have you found work"... you wanna lie on one of those for a few hundred bucks. Take a break, recharge and hit it hard.
