employment drug tests/legal aspects

if an employer has a specific drug testing policy like the 9 prong recreational drug test that is in writing what they test for, could they legally test for AAS just on mere suscpicion, without changing the policy or without your knowledge / consent to test you for that? i dont think they would test for this, but its always a lingering thought in my mind, the legality of it. anyone have any leagl knowledge on the topic??

I'd imagine that the employer would tell you what you are being tested for, or if someone were to ask, they'd be able to get some information. I'd bet though that if you agreed (at the time of employment) to submit to drug testing, it would be all inclusive, although I doubt seriously that the "average employer" cares about anabolics. Plus, I think the testing is much more expensive.

But, good question about the legality of changing policies, etc. I'll bump that up to the legal folks on the boards...knowledge is power.

I am sure that if you worked for a big enough employer, you could find an attorney who would love to take that case.

its just a random test 2 x a year, not everyone is tested. like a lottery to choose who gets picked, i might never get tested, then again i may get it all the time. just wanted to know if they have a policy in effect would they need to change policy of what there testing for in order to test for that.

You may want to check with chuck999 if he doesn't respond here (haven't seen him on lately). He works in the legal field and may give you an "opinion."
