How can you help the owners…….are you talking about ways were they are able to keep their homes….or will you offer a way to exit their dwelling ?

What impact if any will this have on their credit profile ?

There are many ways to either keep the home or sell it, this is ultimately up to the homeowner what they would like to do. If a homeowner goes into default, there are always negative credit consequences. However, if we can intervene before the foreclosure proceedings are totally complete then yes that individual would be spared having a big stain on their credit report whether they chose to stay in the home or sell it. (There is a huge difference credit wise between a few months' of late payments and a full foreclosure action). A good example situation would be last week when I had someone call me on a Friday whose property was going to sheriff sale on the following Monday. I filed for a continuance that same day in their county court to postpone the sale by two months, and submitted a well-structured forebearance plan with their lender which has subsequently been approved. I convinced the lender to also waive some attorney fees, court costs, and late fees totaling about six thousand dollars and change which the borrower would otherwise have been responsible for paying back. This woman had fallen behind after having four heart surgeries to repair a malfunctioning pacemaker. Most of the time, I work with good people like this who have fallen on hard times and just need a little bit of help to get back on track. I will keep track of this thread frequently so I'll be happy to answer any questions you guys may have.

Banks are more willing now than ever to try and work something out with a homeowner rather than foreclosed on a property. The last thing they would want to do is hold a home in inventory during these more challenging times. Now if this were during the boom where the home can be sold more easily, then the homeowner wouldn't have a chance to negotiate. The worst thing anyone could do is not call the bank to let them know they are experiencing challenges or ignore any notices. Also, the government is now stepping in too.

With respect to the lady and the heart surgery, that is unfortunate. Does she have any family ? As soon as she started to experience the health challenges, she should have moved assets out of her name. Unless she is in a Homestead state, her home could be taken away from her anyway due to medical bills. Moreover, with less assets in her name may make her eligible for Medicare/Medicaid. I know several financially well off individuals that have done this. Bottom line, million dollars on stash or not...one serious medical issue and your entire savings can be snatched or used up quickly. Keep in mind my comments stems from not knowing her true condition and predictament. But if she fell behind before.....it's likely she will do it again since she has the medical issue. She needs to speak with a good Financial advisor and attorney. Now that you have helped save her home....please make sure she speaks with an advisor and attorney.

I won't say you are wrong about never having a chance, but I disagree. Banks do not profit from their REO departments in any real estate market, to foreclose is always to lose money because of the costs associated with foreclosure (inspection, legal counsel, and possible repair costs, etc.) They and especially their investors never like to see foreclosures on their books. You would be surprised how grievously inept loss mitigation departments can be at some well-known banks. They will offer assistance in the form of a plan which is unreasonable and the borrower cannot follow, so it puts them right back at square one. That is where my firm comes in, we are able to present a resolution which is mutually beneficial to both parties right from the start. You do bring up an excellent point about financial planning and it is worthy of mention that I consult with every client on an individual basis and bring issues like this up often when I feel it is beneficial. There are times when I feel like it falls on deaf ears though. I have refused to work with people in the past that demonstrated by their actions that they BELONG in forclosure. It's that old saying about leading a horse to water. Thanks for your input, do you provide financial planning? I have plenty of possible referrals. ;)
 
I don't think I said Banks profit for the REO / mitigation areas...but if I did that was not my intent and I apologize for that. Last thing banks want to have is its inventory increase when the housing market is in a slump.

Your timing IMO is on point with what you are doing. Competition may be high so definitely be agressive in getting your name out there to those that may need help. I am hearing there will be another surge of resets coming in February and March. My cousin has given me his sign on to ForeclosureWorld.net. The info available varies from state to state. Some will list pre-foreclosures...some will list owners in distressed.

PM me or post here, your area and I can see what is listed in your area. it will usually list the homeowners name and mailing addy. Not sure if you have a flyer or even willing to knock on the owners door....but I can see what is available and you can create a strategy to approach these people.

I don't do financial planning. I have my licenses (Trading) , and know a little something about Trading....but financial planning is a little more involved than what I know. I only have a broad knowledge on the basics.

I've seen lenders not come after the homeowners who defaulted on their loan,they even did not report it to the credit burial more than once so it was easily removed...but ..no one can guarantee what the lender well do...A foreclosure is stressfull......yet an opportunity non the less..okay so its been a year your credit shows a foreclosure,the guy at Automall says he could fianance you the BMW750 if you did not have a foreclosure on nyour record,so you research :how to clean your credit.You read that foreclosure is a federal record,so you go to your local court house and fill out a form to have your foreclosure records shipped to your locak court house for viewing,meanwhile you have a certified letter equifax,transunion and experian...You ask them to remove the following accounts for being unaccurate and false and not belonging to you even ask them to remove the foreclosure....the credit bureaus write the records building that has the foreclosure,however when the lady looks for it its gone..So she can't verify it in the ,30 day,time perrid allowed..course this only works for a couple months or years yet you only need it til you make the first payment lol
