Well Ive just been offered a DVD documentary on Vander V , they want to do like a DVD documentary where they film in my home town and the daily things i do eat, train, work ect. They are also expecting me to be in top shape around 5% or so , In the contract it says every 15 days i must send in photos to make sure Im improving towards the filming which I can completey understand.

Ive been off and clean for months and thought I would continue but this oppertunity has come up and Im thinking it may be a cool thing to do and have for the rest of my life, so once again Im faced with getting back on , BBIng seems to pull me along and so far Ive just gone with it .

Now they have given me a price and its all in the contract that Ive read over extremely well , eberything looks cool and what they ask out of the athelete is very fair so it looks like a go , my training and dieting starts NOW cause they want the DVD done by July or August, my current weight is 235 and a bit fat so Ive got my work cut out for me.

Id like to ask all of you on Promus what you think about this offer and oppertuninty , what do you think i should get paid and what seems fair , i know the price but Id like to hear your thoughts, now dont forget this is something I can have for a lifetime and my family and friends can share.

dude no offense but why would someone want to buy a video of you. you havent done anything on the national level let alone the jr. national level. better make sure they aint gonna market this towards the gay crowd. again i mean no offense you are/were a great bodybuilder with alot of potential but a video??? heck someone as sucessful and advanced as phil was and he doesnt even have a video.

It doesn't really matter to me why they're interested nor what they're plans are. If they plan on paying you fairly, and give you royalties for each DVD sold, AND they claim only the rights to the video they shoot of you and NOT of your image, then that's fine.

I would be weary of any contractual obligations to endorsements. That is, I'd say it's fine if they pay you up front for a certain amount of endorsements. Beyond that, make sure they have a line or two in there that states that you will receive payments for each additional endorsement of these DVD for advertising purposes whether in print, video or electronic form (CD, DVD, EMAIL, whatever). You don't want to sell your image and have them whore you around for free.

I wouldn't be able to tell you how much to ask for, but I do know that you should be receiving royalties every time your image is used.

Since you are supplying them with progress pictures you MUST MAKE SURE THEY DO NOT USE THOSE AS THIER PROPERTY. In other words, if they wish to use these images for thier DVD, fine. If they wish to use it to promote thier DVD in magazines, tv, print or email - they MUST pay you per use. Do not let them lock you in to that.

They want you, so they have to pay for you. It doesn't have to be a crazy amount of money, but it does have to be fair and substantial. I know of at least one pro here who donated his image to a book that he was never paid for, you do not want that to happen to you.

And since you're going to be busting your ass to get in shape so damned quickly, make sure in the contract there is some sort of lower and upper limit for an acceptable appearance. That is, make sure a minimum and maximum weight is stated; A minimum and maximum amount of bodyfat. Otherwise they can look at your pictures, film you and then say, "Well, you don't look as good as we thought you would, sorry.". Screw that. Get it in writing.

Then, even if you do not meet thier demands, put a clause in there that says they have to pay for your protein, vitamin and other supplements you take (legal supplements, of course). That way if they refuse to use you, they still have to reimburse you for your efforts. So keep your receipts.

That's all I can think of. Look, contracts are a bitch and they are not negotiable. You have to be up front and ask for what you want. And don't give them a direct "Yes" and "No". Tell them you'll get back to them each time and then give it a day or two to think it over, post the contract here if you want, and let those who know help you with it.

Hey no offense taken bro but i guess its not always about what one has accomplished but who and what one is , I think they want a more marketable look i guess , about gay people buying well i do take offense to that comment , gay people are more then welcome to buy anything they want who am I to tell them different and how can I pick and choose whos going to buy it:confused: , Hey im just here to get the job done and have a great DVD something i can have for a lifetime , you mentioned Phil , well yea i havent won the USA or done any pro shows but not everyone that trains trains for BBing or the USAs most infact do it for a healthy life and for fun so maybe im in the right area for this who knows I just wanna have fun with it and thats about it , thanks for your thoughts.

Thanks man this helps .Just so ya know they have done alot of espn work and dvd documentarys on pro Bbers as well so its extremely legit and that helps alot.

is it repetrope vander? i just mention them cause when i did collegiates they filmed the whole thing. i bought the entire show package which included a backstage posing tape. i have nothing againest anyone homosexual either but when i watched the tape it kinda made me angry the way it was presented. i just hope you have some control over the way its marketed etc. your mug could end up on a penis pump like phils, lol. good luck

I have to disagree - contracts are very simple. That's why they are among the first things taught in law school. Most contract law is basic common sense.

Vander - all aspects of a contract are negotiable - that's the nature of a contract. In order for any contract to be valid you must have "a meeting of the minds". This means that both parties understand their rights and obligations under the contract, and are okay with them. After that, it's all give and take negotiation.

I gotta agree with Coopie on this.

The contract SHOULD be simple to read. Sometimes they make it complex (and it is often simply because their lawyer feels the need to show that he is doing something).

I agree that everything is negotiable. Whether they pay you more upfront or less and you get royalties should balance out. If you opt for less upfront and royalties, then you are both splitting the risk a bit. If you have lotsa money, then you can take more risk.

Also, if they want the pictures along the way, so what? Just so both of you know that is what is going on (if that is the case) then who cares? It is included in the price.

I DO like the suggestion of a flat fee for you to work to get in shape, so you are not out the time and money if you somehow fall short. Obviously it couldn't be too large an amount of money, but it does show their committment. (I would just ask for money, not reimbursement since that would be lower. You can still deduct the costs to get in shape as a business expense. Save those receipts! This will include gym fees, supps, etc.)

If the figures are big, have an attorney look it over just to be sure. However, frankly, I am not an attorney and I sign contracts all the time (but they are specialized and I know more about them than the average attorney).

I second that motion...

As was mentioned before, spend a few dollars to cover your rump and consult a lawyer. Have them look it over, give you his/her outlook on it, and get the opinions of others in the industry. Just a precautionary step that could save you some green in the future if this deal goes to shit.
 
I am curious as to how your name would sell DVDs. I mean no offense when I say that outside of a few boards you aren't all that popular in the sport and you haven't won anything so I don't see what the attraction would be not only for them to have you do something like this but how they figure anyone will purchase it. ?? I could see you doing a training video because you have the look and are marketable (until you open your mouth - sorry, but I can't go through an entire post and not be at least somewhat deragatory - people would talk, ya know?).

More power to you when I say that I think it is great that you can make money from your position in or around the sport, I really do. I just don't see what the draw would be for someone to have you do this and why they think it would sell. *shrug*

I guess you've never seen a music recording contract. I've played in several bands and the first two times I signed I signed away royalty rights for my image and music samples. They're now still using our music without royalties simply because one line stated that they had the rights to any and all recordings in the studio. We thought, sure. And they then took those samples, looped them, made similar songs to the ones we produced, and thus were fucked of our royalties. Just FYI.

Contracts are not negotiable once they are signed. There are also verbal contracts, and given your extensive background in this area, I'm surprised you didnt' mention this in your post.

good for you man.. honestly, whatever makes you happy do it.. i know you were talking about getting married, have a family, etc and doing all the right things which is great.. but until then or even after whicever you decide, do what you want and enjoy yourself..
