O/T Anyone ever beat a speeding ticket, if so how did you do it?

Ok Mr. Lawyer, go fight the Ohio Supreme court. Challenge their decision! Go right ahead! It is not my interpretation of the law, it is the Ohio Supreme court's. I am just reporting to you what they decided. If you do not like it and think it is unconstitutional then you should challenge the decision.

In his dissent, Justice Terrence O’Donnell wrote that a police officer’s credibility – just like that of any other witness – is to be determined by the jury or other fact-finder, which can believe all, part, or none of the testimony. “Thus, I would assert that a broad standard as postulated by the majority that a trained, certified, and experienced officer’s estimate of speed is sufficient evidence to support a conviction for speeding eclipses the role of the fact-finder to reject such testimony and thus such testimony, if found not be credible, could, in some instances, be insufficient to support a conviction.”



This dissent hits on what I meant.
We all know the dissent has no impact on the case at bar, but his train of thought is mine as well. In the case you cited the supreme court held that a trained officer's testimony is sufficient to meet the burden of proof, but a jury does not HAVE to always believe the officer if they question his credibility. A jury can always question a
witness's credibility. This case does not force a jury to always believe the officer, if they don't believe him they wont convict.
Case addresses burden of proof and what meets that burden

Oh, I agree with you 100% believe me! I think it is utter bullshit that the Ohio Supreme court came to that decision. I just think its important that people see what they are up against. IMO your only chance of getting off is if the officer does not show up.

I am unfamiliar with how you can request a jury trial. All I know is that I plead not guilty and then they set the next court date. Both time no officer showed up.
So I guess in SOME states you can request a jury trial if the officer shows up? Is that how it works? From what I read some states dont even allow a jury trial for a minor traffic offense like speeding?

Let us know how the process works for getting a jury trial for a speeding offense. I have read about it but do not know a thing about it.
 
Went to court yesterday, they dropped the points and I just had to pay tyhe fine... talked with the trooper after and asked him if asking for the calibration of the tuning forks would of worked and he said the judge would of not took that into consideration and he hasn't ever lost a speeding ticket trial and hes been doing this for 11 years.

Man you got lucky! They dropped the pts!!?? Did the judge say why? I have never been so lucky. Makes me think that maybe I should go to court for every ticket now instead of mail it in. Was this your 2nd trip to court? The officer isnt present in my state unless you plead not guilty the first trip and then come back to challenge.

They always hit me with the points and fine. Maybe it was the only ticket on your record?

Betcha it was because it was his first ticket. They always cut you some slack on that… usually.

Honestly depending on how bad the speed was just go to court early find the cop and talk to him calmy and just be like look man i know i fd up is there anything you can do to help me out? Hopefully he says he will drop the points and just give you a smaller fine. I mean thats what i have done everytime and had a lot of them dropped. I just go in and talk to the officer or even call him and leave a voicemail. Just ask if he could help ya out at all. Thats basically what a lawyer does

Ok, so before the court date you call the officer up at the police dept? I guess you get his name off the ticket? Ive never tried that.

lol, nope 2nd speeding ticket that was still on my record from 09 and another pending ticket from the same nite that i got paced on. The prosecutor stood behind me like he said he would and didn't tell the judge about the pending ticket, I have an illegal left turn on my record and an accident where I slid a Dodge viper off the road but i didn't get a ticket but it shows up so she said she would drop the points and if I didn't get another ticket in 12 months it wouldn't go on my record.

Damn, you had a very nice judge! So if you get another speeding ticket the judge will in effect give you 4 pts on your liscense(2 pts for the new ticket and 2 pts for the one you just had)? I would think that when you get no points now that they couldnt go back and add them later.

Its 4 points for 15 over so depending on how fast I was going if i got another in a year it could be 2 to 4 points plus this one.

There is no process you have a constitutional right to a jury trial
This is a criminal charge and a jury trial is your right
As a defendant you are entitled to this period

You don't have to go to court to plead not guilty, you just call them up like the day before and say that you wanna plead not guilty and they will send you a trial date in the mail!

OH, LOL! That would have saved me some trouble. So how do you get the jury? I know for certain in Ohio that I did not get a jury for my trial, and I was in court when I plead not guilty. The judge never once mentioned having a jury.
 
Laser Shifter
