anyone ever have to deal with this, i think i may need to get a lawyer. i know the laws differ from state to state but i figure the process is similar.


i have a 2004 mazda rx-8...............coincidentally the 2004 car of the year:(
 
The BEST place to get car ratings and is actually pretty damn accurate, is consumerreports.org.

The BEST 5 manufacturers(quality/longetivity wise):

INFINITY
LEXUS
ACURA
HONDA
TOYOTA

Anything else and you will probably end up paying more out of your pocket in the long run, and the reless value will suck.

The worst cars are (I have one):
VW
AUDI
And the rest of American Domestics :)
 
thanks for the input putin. but as i mentioned this car was CAR & DRIVER 2004 CAR OF THE YEAR. i did my research when i bought it, the 1st nice car i have ever had, it is bad-ass looking silver with black tint, 19" rims, spoiler, bose system. the dual rotary engine is SUPPOSED to run forever, well this is not the case, the car has about 26,000 miles on it and is once again in the shop and they cant figure out the problems. i also like it because there are no others around in my area, its unique, not every tom dick and harry is driving one, hell now i know why:eek:
 
it depends on the state your in.. when i was in the car biz, the lemon law in my state was if the car had the same issue three times in a years time.. of course.. this applied to new cars only at the time..
 
hey bro are you taking it to a mazda dealer? if not then do so. lats is right 3 x's in year for the same repair, but you kinda have to go through steps. here is what i suggest. go to the dealer.....if they cant fix your problem or find your problem then ask the if they have an in car data recorder. so when it does act up on you then all u do is press a button and it will copy all of the data needed.( hopefully.) and i think a 2004 with 26000 miles is a fairly new car. if you cant get anywhere after that then tell your dealer you would like to meet with a mazda representitve or an fse (field service engineer.) just dont lose your cool though. in these cases you get more flies with honey...ya know. out of curiosity what is the problem.

Just saw how acura is supposed to be a reliable car. I owned a 98 acura TL and its transmission went out at 32k miles. It had to be replaced, and took Honda 6 weeks to get it done! Turns out it was a big problem in those cars, and they didnt have enough trannys in the warehouse to meet demand. Needless to say I wont buy another Honda again. Im driving a nice Audi A6 now and love that. Have had some minor things go out, but all covered by warranty.
I hope you have luck getting your car fixed. It was a nightmare having mine done. The jerks gave me a ford taurus to drive around for the 6 weeks while the acura was getting fixed. I think, like someone else stated, you have to give them 3 attempts to fix the problem before you can pursue the lemon.
 
hey bro it depends on the state u live in.here in s.florida if it goes in for the same problem 3x in the same year they replace it.now here is the catch they dont do it on the 3rd time.in other words u take in 1time 2times 3times for the same thing then on the 4time in is when they replace it and they dont give you a brand new car they give u a car that has the same value as your's is worth.it could be new but not more expensive than yours.it happen to my friend with his bens.best advise will come from your lawyer.good luck bro hope it turns out good for u.by the way my same friend just brought his son the new rx8 and got the rx9 for himself.i drive the rx8 all the time gotta love the color of the dashboard.he wants me to drive it like its stolen to see if i can blow the engine within 3 month time.mind you he has more money than god so thats why his crazy like that.
 
due to it being a dual rotary engine mazda is the only place that will service it anyways. they gave us a tiny mazda 3 to drive, nice, its like a fucking go-cart. well this is the 3rd time and the car is still under warranty.

Since not too many people have these kind of cars, it's hard to determine the quality/longetivity and the problems these cars have. In short, it's hard to get ratings on it.

That also depends on if you were the first owner or who owned the car before. Was it a stick?

Also Audi is only covered to 50k miles. Well, so was my VW. After 50k hit, everything started to fall apart, electrical, engine, seats, etc. Yeah.

I was the first owner of the Acura and it was an automatic. The problem was only in the automatic. It extended to most hondas that had the 6 cylinder and an automatic. I know the problem was even found in the Odysey minivan.
Yeah, my 4 year warranty on the Audi runs out this month, ive got my fingers crossed that it holds up good. I know several people that own Audis with over 100k miles on them and they are all doing good. Mine only has 34k miles on it now, so still fairly cherry.

As LAts said, if your car has to go back to the dealer 3 times in a row for the exact samething AND the dealer feels it's unrepairable and it's truely a problem of the car manufacturer then your car can be replaced. And the lemon law applies to you. Personally I have heard and even read really bad stories of people who wanted their money back and the dealer refused simply because it's a loss to them. Storeies ranging from a guy a few years ago who took his car down to the dealer and let people take a whack at it with a sledge hammer for a few bucks, to a guy who drive his truck through the front of a dealers showroom windows.

I hope you can get another car bro or at best switch out to something else with no hassel.

WOW. Sorry edge. Pretty cool car actually. The three times rule is what I've always heard down here, but I've never known how you actually get your money back. Probably best to talk to a lawyer who would know this stuff.
 
mazda is replacing the whole engine with a new one. no charge, i just have to cram my ass in an mx-3 for 2 more weeks. so it will basically be a new car, i just put new tires on and a new sound system in it. hope this engine is better than the 1st.:)

they explained the whole thing to my wife so by the time it got to me it was basically broken down to......new engine, lol. for whatever reason there is something with the 2004's (the 1st year for this model) that is defective, they have another one at the same shop with the same problem.

I know it's the same companies but still the cars are different. Honda Passport for example had a shit load of problems, so they just trashed the car completely, no longer made.

Infinity vs Nissan, infinity is better quality than Nissan. Dont know why they do what they do, but Nissan sucks compared to Infinity in quality wise.

You're wrong on the BMW tho. They are consistent with electrical problems, just like Audi and VW, among others. I'd rather take that 35k and buy an Infinity instead of a BMW.

Electrical problems are hard to diagnose and fix, my wife's co worker bought one and it's been in the shop ever since, all electrical :)
