I agree. She posted ahead of time that it was his idea and I believe her. Was it stupid? Hell yes!!! If stupidity and ignorance were crimes - most of the free world would be looking at prison time. But I don't believe either one of them knew how powerful guns can be. Wish there was more details in the article.



Lol actually stupidity and ignorance ARE crimes many times. It's called negligence. The legal definition of negligence in a criminal context can be pretty accurately summarized as stupidity or ignorance: you didn't intend/know this would happen but you should've known. It's a lesser charge but a crime indeed. Example is manslaughter which is negligent homocide: you killed someone without intending to kill someone while doing something you should have known could likely kill someone. This is often applied in the context of DUIs that result in death (you didnt intend to kill anyone but you shouldve known that driving drunk could kill someone) or flawed self defense cases (ok we believe that you thought you were defending yourself but you should've known that you didn't need to shoot the guy in the halloween custome waving the plastic toy sword), but also used when two idiots having fun result in one dying (girl convinces guy to shock her nipples with car battery during sex and the girl dies from shock - true story btw)...

If you ever read about criminal or civil negligence, you'd be amazed at the level of stupidity out there.

By the way, her admission on twitter prior to the shooting that the stunt is "one of the most dangerous things ever" will make a manslaughter case pretty much a guarantee. That alone would possibly be enough to show recklessness for a second degree homicide charge which is more serious.

this is where mens rea (intent) comes into play.. she clearly didnt intend to kill her boyfriend.. nor did she foresee his death as the probable outcome.


the prosecution would also, of course, first have to prove actus reus... now while she obviously did pull the trigger, the fact that she didn't think doing so would result in a criminal offense could prove problematic.


i see this ending up in civil court, if anything... and i doubt the dead boy's parents will sue.
