Nothing like some unnecessary stress added to one's life, right TKAV? You'll be just fine. You help someone out and then they turn and kick you in the nuts. Nice. Like it was mentioned, just more ambulance chasing by lawyers. They will do the song and dance and walk away with nothing when its done.

Let's not forget the fact she checked out of the hospital AMA to go to the casino. This alone says a lot about her "injuries" and state of mind when the injuries occurred. In a perfect world I'd say you have nothing to worry about. Unfortunately this world is over run with greed and lawyers looking to make a quick buck.
 
When I did CPR/First-Aid class back in the states in 2005 (not sure if if the law is still the same), you NEED some type of approval from the person choking before performing abdominal thrusts (I forgot the name of the legal term, sorry) to clear you of any legal issues. If the person is unconscious to begin with, then consent to perform life-saving procedures is automatically granted (even if broken bones result).

It sounds crazy to ask a choking person if its OK to aid them but it will clear you if something like broken bones occurs.


I believe you are referring to "Informed Consent" While this is true with an adult of sound mind who is able to speak, you act under "Implied Consent" when one cannot speak (like when they are choking) or they are unconscious. Regardless I think you will be fine. As previously stated, I know I am doing good CPR when I hear crepitus.

Lawyers really do fuck up the universe! I remember learning about the good samaritin law during nursing school. It is real and is there to protect good people like you! You did the right thing bro!
 
I can tell you that if your attorney has even a degree from a fly-by-night college, they'll be able to get you off. 'Good Samaritan Law' works and is in place....to an extent. For example, I'm a Registered Nurse. I'm certified in Basic Life Support, Advanced Cardiac Life Support, Pediatric Advance Life Support, and Critical Care Nursing. If I pull up to an accident and start performing CPR and bust a rib or their sternum, I can be sued because I have 'proper teaching and training'. The 'Samaritan Act' is in place so those who are simply helping another in distress won't NOT help for fear of being sued. You should be fine.

I just think it's ridiculous that some people only think of the money when they nearly lost their life. Sounds like she needs to be eating mashed peas instead of cheesecake....
 
I am, its the point that this lady would have been dead on the restaurant floor, but i have to deal with this crap for helping. and people wonder why when bad things happen its rare that someone steps in to help. oh well, a day in a court room will give me a few hours away from work, kind of like a field trip :)

they'll be awarded $1, i've seen it happen before.
 
i'm echoing what everyone else has said. the good samaritan act will protect you; there has not been one case tried where someone acted in good faith and was successfully held liable for any damages........

I agree COMPLETELY!! I'm glad there are people like him still in this world. If that was my grandmother, I'd kick her ass for trying to sue. Of course, she was a nurse anesthetist so she understands...
 
In the past 25 years i;ve performed CPR probably several thousand times....90% of the time ribs crack, sternums break, ESPECIALLY WITH GERIATRICS. I know people are gonna come up hear and say, "not if you do it correctly", but the fact is she;s old and most probably osteo compromised.Don't sweat this bro, it won;t even go to trial. You're covered under the good samaratin, especially since you saved her life. No decent judge will take it past preliminary. Be certain your attorney makes it clear you will seek recompense for his bills as well as the stress you endure over the ordeal. Hey, it's a great time to see your doctor for a Xanax script...all that anxiety, fear and depression for doing what a proper citizen would do.
 
I'll try to make this short.

early last week, an elderly woman, 87 to be exact, started to choke in the restaurant. after yelling "Shit!", i went to the table and gave her the Heimlick. it didn't work on the first try, so i put a little more oomph into it. on the second go a rather large piece of cheesesteak came out of her throat. during my second go i hear some cracking, mind you 911 is on its way at this point. she says she's fine but i insist that the paramedics take a look at her before she leaves. i talk to the police and paramedics when they arrive, the medics check her out. they want to take her to the hospital. she wants to go to the casino, so she signs out A.M.A and heads off to gamble.( i live and work just outside of Atlantic City NJ). today, i walk my sweet ass over to the mailbox to get the paychecks, my staff really likes money, and there it is, a summons, and a letter from an attourney(why cant i spell that?). so i get on the horn with the owners, they say dont worry about it the lawyer will take care of it.


Not that im worried or anything, i mean hey, she would have been dead on the floor, but REALLY? shes suing me for breaking 2 ribs? thats bullshit IMO.
sorry just wanted to rant about that.

i'll bet her family, aka adult children, talked her into suing. you should be alright per some kind of good samaritan law. congratulations on saving a life!

Thanks everyone. I'm really not worried at all, the company i work for has a lawyer and like someone else already said, it wont even make it to trial. It was a little surprising though that she would try is all. To be honest im not too sure she's all there up stairs.


See, here's how this works. Atlantic city is run kind of like air traffic control. These bus trips for seniors come from all over the northeast US and canada. well the busses only have a 15 min window to get into their spot and unload the passangers at whatever casino theyre going to. the place i work is in a colonial village 10 min outside of atlantic city, and the buses, being schedualed the way they are use us as a stop over on their way. so theyre usually here for 2-3 hrs before heading to the casinos for food and shopping.

so the rundown for this year is 1 heart attack, 5 people fainted, 3 choking, 6 siesures, countless slip and falls, and 1 death(just died of old age apparrently.)fell asleep on a bench and never woke up.:(

this is the first time someone tried to sue for being helped. well since Ive worked there anyway.
 
Its stories like all these ones that made me decide to chuck my first aid and CPR cards in the garbage every year even tho I hafta do the training thru work.

Quite a few years ago my brother came up on a car in the ditch, up against a tree. He threw his coat on the driver then helped hold his head straight and still, fearing a spinal or neck injury. Later the guy tried to sue for being "restrained" against his will.....WTF? In hindsight I'm sure my bro would've drove right by. I woulda stopped and kicked his head sideways through the window, LOL.

I'd probably help someone, but I tell myself I would just keep scootin by and let someone else deal with it. People suck, to be blunt.
 
This is crazy! If the court ruled against you, then the message would be that we shouldnt help people in life/death situations...

As you already said, there is nothing to worry about in terms of losing, but still.....this is a disgusting display of our system..it should be thrown out of court in a hot minute...

It was definitely someone that wasn't there telling her to sue.. I wouldn't worry about it but then again.. our government is so fucked up
 
!! I'd been a linebacker since I was 8y/o, and this was lining up to be a PERFECT Bo Jackson vs. Brian Boswell moment. Then I flashed to being handcuffed, almost surely breaking something on this guy or knocking him into traffic...so I let him run by.

It was the worst I'd ever felt and I still use it as a lesson about opportunity and justice for myself. I made up for it in my future work though, but it was always on my mind.

I hope this guy doesn't try to kill your uncle one day.
Seriously though, what would anyone pick -
Broken ribs or death?
