Normally I wouldnt do this, but I need it....

I had to leave due to stress at work, I was not being given lunch, I was being told I had to do things that were not even possible for two people to get done in a day (I was a computer tech) the boss treats all his employees like shit, and after I told him I had to take a few days off work (told him 2 weeks in advance) he said for what, it had better be important, I told him my training partner was doing his first body building show and he was like AND THATS MORE IMPORANT THAN THIS?

I was getting paid 135 a day before taxes and bringing in 1000 a day by myself.

I have been trying for 6 months to get a job, and I just cant, so now I am out of savings and NEED unemployment... can you guys give me some tips to make sure I quality? What do I need to tell them? How do I do it?!?!

im on it, you have to work steady for 2 years and you cant quit, have to be fired, i get over 200 a week for a year for doing nothing, not to bad but not a living

If they haven't disabled all your accounts vpn in.. And take down his PC/network/dns/ or whatever strategically you can do with out being obvious. You can then call back and offer your services as a contractor. Forget unemployment. Make yourself more valuable and write your own ticket. Bro this is your world, take ownership!!!

Im not that kinda guy.... they disabled my stuff but I am the one that set it up so I can still get in... I know all their admin passwords and shit too :)

The requirements are different from state to state.. My state for example, you don't even need 2 steady years.. Also, you usually can't "get fired" for a bad reason.. It's more along the lines of you having to get "let go" for it to be an easy process..

What happens is you file for it, give the reason of why you're not working anymore, and they contact your former employer.. Your employer has the opportunity to appeal it, and they do this ALOT if they feel you shouldn't get it, for example they fired you for doing a shitty job.. They may exaggerate the reason in their favor, or maybe make something up.. Reason being, when you collect off THEIR insurance, their premium goes up every year..

So there's no real "tips", I don't think.. Some states it's easier to get it right now, and others it's harder.. It all depends how much money is in the state unemployment insurance account.

i am sitting here chuckling at a line of code in one of the programs that i wrote for the internal accounting system that checks if my active directory account exists, is active, and has been logged into within the last 20 days.

Its funny because it is hidden in some funny piece of code that actually does nothing more than ping the database server but if it returns false, nothing automated works. I gotta take that line out, i just suffered a moment of moral and ethical clarity=-)

Wow!:eek: You quit your job in today's economy? You should never leave a job, before you have another lined up. Boss treats you like shit? Alot of them do, maybe you should start your own business if you can't get along with the boss. Computor jobs are still out there. Your boss was paying you 13.5% commision, that is pretty good. And yes, YOUR JOB IS MORE IMPORTANT THAN A BB SHOW! Looking for a job? Go to fast food places like Mcdonalds, they are always looking. Questions? How bad do you want a job? Are you spending 8 hours a day looking for one? Well, best of luck, I hope you find one.

Again laws vary from state to state for unemployment, but that is a federal one. You can't quit and get unemployment, you would have to be terminated or laid off because the ss office will check with your employer.
While you may not have a unemployment shot, you definitely have some sort of suit that may get you unemployment for breaking federal employment laws, if you can prove it. Again, providing that you were not a salary employee.

I would think if you havent filed a complaint since quitting 6 months ago then it would be harder to file it now. Me being a gov employee would be easy to file a grievance but not sure under non gov employee, lawyer? Wasn't aware of required 2 breaks a day.

It's on the labor laws poster board here in our breakroom, that may or may not be federal thing with the breaks but the required lunch for any employee, that is not salary is federal law.

I would call an employment attorney if you want to go that route, from what i could find there are statues for both federal and state discrimination, average was 180 days from the incident though.

I wonder how those laws apply to someone who is not an hourly employee but commission based. I believe the OP stated that he was commission based. I know that when i was working hanging drywall while going through college, i was paid by the piece so i could work as little or as much as i wanted to on any given day.

all i know is i have been constantly reprimanded for not taking my lunch and breaks because i am an hourly employee and they made me read that board as to why it is illegal for me to do so. I guess the point with salary employee is that they just have to put in 40 hours to legally get their salary, it doesn't specify how they get those 40 hours though in our books so long as they do so.

no it is not. there is no federal law that says an adult be given any kind of break in an 8 hour period. it varies from state to state but generally you will not find any since they are usually negotiated at each compay. look on the dept of labor website and you will see this.

good call iceman, i went back and read our board again, and while it says federal there are some printed items that weren't on the original board.

Not true. I quit and still got approved for. The way it was for me several years ago is they moved my work location really far from where I lived to get me to quit because the mgr was a evil dick. Well, I quit, filed a complaint with Texas workforce commission and still got upemployment pay. The dick eventually got fired for over 25 HR complaints. He better hope I never see him.
 
well i got denied, i almost got it and the employers made up some serious bs to make it seem like i quit and they even went as far as to say i had friends in unemployment and thats why i was gonna quit... they had better hope i never see them again, i saw one of the employees in a parking lot, and he saw me and started running. it was funny at one point the boss asked me "do you wanna be a computer tech or a body builder?!?" im both, its not one or the other, but im also a boxer and uh.. i outweigh most of the employees put together haha.

Anyhow, the fucked up part is one of my good friends worked there and i asked him to talk to unemployment for me, and it would be totally anonymous, and he told me that he didnt wanna get involved, after i stuck my neck out for him time and time again. pissed. oh well. im starting my own business.

Superbeast, let me tell you that you CAN win. It is far more difficult when you quit, but certainly not impossible, I speak from experience.
#1. If they indeed (and it varies by state) violated labor laws during your employment, cite the law and violation at your hearing.
#2. Speak of the intolerable level of stress you were experiencing, and if you were seeing a counselor for depression/anxiey and discussed your job with them, ask that they type a letter for you on letterhead verifying that you are being treated for these issues. If you were not seeing a professional, try talking with one now and build a repoir. They may be empathetic to your plight and may write you a verification letter in time for your hearing. Being treated for depression and/or anxiety puts you in a legally protected class and betters your odds of winning by alot.
#3 Get as many former employees (and current if you can, but that is of course difficult) to write letters of even show up to your hearing to voice support for your contention that the work enviornment is indeed abusive. If you were being abused, chances are many others were also, and you'd be suprised how many people you contact will still have enough bitterness toward the company to help you.
#4 Prepare ad nauseum. When it is your turn to present, know your argument inside and out. Act like a good lawyer; be prepared for any curveball that your former employer might throw at you. No matter how nervous you are inside, speak confidently and assertively, looking the arbitrator in the eye when you are speaking.
 
thats exactly what a guy with no money and no means needs to do. go hire a lawyer with a $2500 retainer and $350 an hour to file a lawsuit against a company that probably has a contingent of lawyers ready to paperwork him into bankruptcy long before any court will ever hear the case.

why do people always jump on the "fuck that bro you should sue them" bandwagon? do you guys have any idea what it costs to do that shit? i am in a lawsuit now and it has already run me $7500 and we are only halfway through the damn thing. everytime my attorney calls me it costs me $100.

beyond that if you quit a job withour having filed grievances and complaints of misconduct and poor working conditions then you are fucked. bottom line. that is the end of the conversation. you can try to find that legal loophole that junior wannabe lawyers think they know because they once took a class or talked to someone who told him something. but reality is far from black and white issues. dont believe me? go to court sometime and you will see really fast.

Beast, it sucks. sorry your out. but you made your bed by quitting. im sorry but in this economy with workers willing to make half of what you were getting paid there is just no need or desire on an employers part to be kind or generous. my company docked my commission rate 4 times in one year and dropped my salary by $10k per year. sure i could have complained but then again they could have just fired me. and sure i could have tried to file a suit but that would go nowhere. and i could have also quit. but who wins then? not me.

bottom line is in todays economy you take what you can get and you try to supplement it on side work if possible. cut your expenses. and try to ride it out.

I agree. It takes money to file legal disputes. Even if an attourney states otherwise they are just trying to get you in their door.
 
Why don't you just take your lunches & breaks as the law requires, work at your own pace and only work 8hr a day 5 days a per week. Let him fire you and then when unemployment asks why you got canned tell them because you where taking a lunch break and the boss doesn't allow this.
