Case dismissed

On 3-23-05 my case was dismissed. i didnt have internet access til now so im updating everyone. 3 years ago when i was 19 i got popped with 1600 dbol imported from Thailand. It was caught in customs and i was arrested when picking it up at the MBE. I was under investigation for 6 months so i was dealing. I was charged for possession for sale and i was convicted 5 months later. I did some jail time, 1008 hours of FWY community service and was on formal probation since 10-25-2002. im off probation and my case was dismissed pursuant to 1203.4 PC which means i am no longer a convicted felon but public records will still indicate i was arrested and had my case dismissed. this totally fuckin BLOWS by the way, it is NOT expungeable. so long to ever getting a good job. mother fuckers at the human resources dont give a shit, dbol or rape. whatever man. actually the judge was about to reduce it to a misd and THEN YOU CAN GET IT EXPUNGED but he was confused with the charge i had. that is only available for Violation Sec. Code 11377 PC H&S (health and safety) and not what i had which was 11378 H&S which is a straight felony and not a wobbler (felony/misd) like 11377. this charge can only be dismissed and not expunged. he thought for a sec i had 11377 but he looked it over. The difference between the charges is 11377 is possession and 11378 is possession for sale. possession is expungeable compeltely but 11378 is not. so this is a good indictator for some of you fellows to let you know what happens if you do ever go down. sale or distribution is not even dismissable but i wasnt caught in the act of selling. just had possession for "alot". get an attorney because i couldnt afford one especially at 19.

Am i doomed to getting a good job? I want a job with the city, state, county or federal govt for now. I do want to go to school but if i become a teacher or nutritionist will i still get hired without a question? thats all i want to know? I'm totally pissed and feel down as I will have to disclose this for the rest of my life and i'm only 22. So if some of you work in the HR dept or know the system, will i still get hired? my case is DISMISSED, i no longer am a convicted felon so it isnt like im applying with a felony on my record. just wondering if it means anything?

when i worked for a company that performed background right out of college.. most companies, even the gov, do not do their background checks themselves.. they hire out..all they care about is that you do not have felonies.. all that the company will tell them is that you had a misd dismissed and most of the details will be not included.. most will ask strictly for felonies unless you get a job that requires much driving.. in that case they will look at all misd to see if they involved use of a vehicle.. if it was listed as a misd than i normally did not look at the text or research it.. most employers want to know about felonies..

I did not have a misd dismissed. i had a straight felony dismissed. i was a convicted felon for 2.5 years and now i got that dismissed. am i good to go? even target denied me employment last year but i just re-applied for the assets protection dept. just temporary part/full-time work until i get a state job, if i do while i go to school. time to clean my life up! FUCK. i need to make money. SHIT

if a felony is dismissed, it can not be held against you.. that being said, they can try and find other reasons to not take you on for a position.. but, technically, they can not use this against you,, it was dismissed.. i would have a consultation with a lawyer to see what the parameters of the dimissal mean in regards to employment.. it would be worth the money.. also, ask what the chances are for getting it "expunged" after the fact.. if a judge hears the case i bet he would rule in your favor.. a dismissal of a felony is like tits on a bull.. it makes no sense.. most will see it that way.. take a chance and try and see a lawyer or legal consul..

Not to sound harsh, but you seem to be giving the blame to everyone but yourself. You obviously knew that the possesion of AAS was illegal and it was a choice you still made -

As far as getting a job, thats tuff to say as i don't exactly understand your dismissal, which is odd for a felony - As far as a governement job ie: teacher, police, ect those are going to be practically impossible to get. They will strictly ask on your personal history forms if you've ever been covicted of a felony or misdemeanor no matter if its been convicted or expunged.

They will strictly tell you NO FELONYS allowed

Hate to be the bearer of bad news

well my case is dismissed pursuant to 1203.4 PC so i dont have anymore felonies. this charge is dismissable because it is a drug charge and first offense. almost all other charges are non-dismissable. read 1203.4 PC this was granted to me by the judge. i cant get it expunged so there is no point in getting a lawyer, i think its basically done. i can see how becoming a police officer would probably be impossible to get but a teacher too? some applications state i do not have to put down any conviction that has been dismissed. im gonna get my fuckin government job, and yes i do seem to be blaming everyone but myself because i dont think a person should be barred from emplyoment because of some fuckin steroids. how the fuck am i supposed to make money? i cant believe i went down for this shit. if i knew that these were the consquences, i would have never touched them. they ruined my fuckin life for good.

well let me tell you about the fed gov. i work for them and have had to do interviews for hiring. if a person puts down that have been arested, guilty or not, whether it was a felony or not we still hire them. we cannot hold that against them. but if you donot put it down, get hired and then your background check comes back that you lied, your ass is gone! and then you cannot ever work for the government. mostof the time the background check may take up to 1 year . so you could be working that long before they find out.
we have hired car thieves, armed robbers, drugg posession/sales , murders, ect. but as long as that is on the application they can work.

as far as the job, most places don't do a background check, so just forget to mark on the application that you have been convicted, lie

I agree that some jobs will hire you if you have been convicted, but don't lie - that is the easy way for termination.

This is what i don't get - It doesn't matter what we as a BB community think about the laws. I'm sure pot heads don't think smoking weed should be illegal either. However it is still illegal to posess or distribute and i can't see how you didn't know that it was a felony. Its been like that for years -

Take responsability and keep looking for a job - If you don't have to put down anything that has been dismissed then don't. If you do then put it down and hope for a miracle.

..

i have a good consulting job right now and i have a violent felony and i put down that i had a felony on the aplication...

my work speaks for itself as i am a good "company" guy and very good at what i do..

you can alsways say when asked they you were importing meds for you and your family without a script and got popped for that... nobody needs to know it was steroids...

you know it could spin that you were importing non-fda approved or illegal meds for your sick aunt...

I feel better

wow thanks for the replies guys! im definately going to disclose it and be honest about everything come interview time. i spoke with a bus driver, he told me even if i had gotten it dismissed, still put it down, "we just hired a guy with a felony" so i feel a ton better knowing mine is ALREADY DISMISSED and have the minute order to prove it to them. also it was a drug felony and i will state it was for steroids too, unlike theft, robbery, attempted murder, etc.

at 18-19, i didnt even know steroids were a felony. i really did not. i knew they were illegal and thought it was a misdemeanor. never did i think i would go down this hard, and it could have been worse so i dont know if i should be angry or happy?

but i feel better knowing there is hope. thanks alot.

paperbolix, even target and walmart denied me employment last year when i checked the box no. seems like all places do background checks except maybe mcdonalds and im certainly not holding a career with a fast food joint like that.

regional mgr make over 80 g a year!! Its not like you would be the fry guy for life!

OK but be sure to tell them it was a steroid felony, don't just put 'drug felony' then they'll think you show up to work wasted everyday-steroids just mean you tend to be a hard training perfectionist that looks for an extra edge..

yup. i will disclose it completely. well heres the thing that sucks. my charge was possession for sale, not possession. but the companies only see the final disposition and no details. still, if im applying with the state, i really dont want to lie about it. that doesnt look good, really.

Don't put drugs or steroids on an application. Put a felony and explain it in an interview if available. Don't ask just trust me on this!

well it was dismissed. i dont have to put it down since it was dismissed pursuant to 1203.4. but on a state app, i have to list it. they want to see a full disclousre. if i lie, i will never be able work for the govt. i would rather not take that risk.

right you donot have to disclose what the felony was for unless ask by interveiwer.and if they donot hire you because of this you can sue.
but donot lie. we had a guy who never put down he had a felony. he had been working for 5 years and for some reason it showed up. well they fired him. they told him if he had put it down first he would have still been there.
as far as drug test they donot test for roids but if you have a complete physical it will show in yourblood work as mine did and i admitted to taking them. my test was double what it should hae been. well i am still here and this year will be 25 years.

i dont have to disclose what the felony was for? they will want to know though.

for regular companies, you dont have to list convictions that have been sealed or expunged, which is what i have. but if you do have to, then i will check the box yes and explain in the interview (and bring my minute order from court that states the dismissal)

but for state jobs, you must disclose all of it even if its expunged.

am i on the right track? thanks for all the help.
oh by the way im clean right now and wont be using for a WHILE. at least until i get my state job and even then i just dont feel like risking anything anymore.

Yes, you are correct about this. For most jobs you don't have to list convictions etc. that you are referring to -- but for state and gov't jobs you do.

I cannot believe that you had to do 1008 hours of community service -- that is a lot. How much jail time did you get? And, where in CA did this take place?

Good luck -- you are certainly past the hardest part.

i reside in los angeles county. i was sentenced 10 days in the LA county jail but the judge reduced it to 5 on sentencing day. i ended up doing a full two days and they released me at like 2-3am. its horrible in there, im white and most if not all of the jail's population is hispanic/black and filled with all the hardcore gang members. i was shitting bricks when i was in there, especially the court "tank" before the bus transports some of these guys to the wayside jail in anaheim between their court hearings/trials. its like a huge room with no one but about 60 inmates. i had to go thru another one too. i did 126 days of caltrans (1008 hours) HWY community service, hard labor, some days you pick up trash, some are hard like tree work. i never did this kind of work and at 20 years old with a felony, i hated my life. im now 22 going on 23 in 6 months and im done with this. im thinking of giving up the gear for good. i really want to do it but a job opportunity is more important to me and i cant give that up. even though im careful when ordering and i still did gear while on probation (just did a cycle 3 months ago) and another last year, i just come to think that it isnt worth it.

even though my record isnt completely clean, its clean enough to get to work. i have no felony or misd convictions and thats all that counts. i also have a clean driving record too since 3 years is up since my speeding ticket in oct 2001. i might not be able to be a cop but i can still get to work. im looking into security work right now while i try to get a state/govt job, and begin school this fall (i can go to school for free..grants/aid) and i think i want to be a nutritionist or clinical dietetian. not only will i learn more about the body and my own body, but also want to help others as well. its about the only thing i have an interest in. i dont like personal training or "business" in general. i would rather have a degree in something. i am thinking of being a clinical dietitian for the state (i.e. dept of corrections) this way i secure a job.
