How is it that if a man drives down the street and picks up a hooker and pays her to have sex with him, its totally illegal. You get caught, you go to jail.
Now, in the same country/state you can hire a woman to have sex with you on video and call it a "porn" and there is nothing the police can do about it?

So, lets say if i pulled over to get a blow job from the curb whore on 1st and miami ct and ask a whore to let me tape her for blowing me for 20 bucks and tell her she is getting paid to make a porn can i still get arrested?
I mean, paying to have sex on tape to make a porn (or on tape) is totally legal. paying to have sex for the heck of it is illegal right?

any lawyers on here? please help me understand this. i guess its the same way cali people can buy pot but will go to jail anywhere else?

It's not that easy, unfortunately...

For what you described, they'd get you for Indecent Exposure if there was a possibility that others could have seen you. And it's hard to prove that no onlookers could have possibly seen the act. The Police would only have to prove that the area is traveled by someone, sometime. The law states that indecent exposure is, "Public exposure with the intent to arouse yourself or others." So arousing yourself would be enough, even without others around...Taking a pee in public is not indecent exposure because the intent is not to arouse.

Worst of all, you'd be a registered sex offender in some states.

If you filmed it and said she worked for you and had a business license for adult films and the girl's information (name and age) was registered at the business' central records office as an adult film actress, it would be harder to prosecute you. But then you'd have needed a permit to act in the location where you were caught. She'd need a license as a tax paying self employed actress (contractor). Or worse, if you said she was employed by you, they could get you on non-filing of withholding taxes (tax evasion) if the period of employment was said to be longer than one year.

Then again, if you bang your chick or some hooker against a giant window inside your home, on a main avenue, and a crowd gathers to watch, you'd be ok in some states. You're in your house and its their problem if they are offended by it. Weird, eh.

"TAXES" plain and simple. There are quite a few states in the US where prostitution is legal! WHY? Simple, "TAXES" those prostitutes pay taxes on their profession. Those states where you find they do not pay taxes, prostitution is against the law!

Example: street hookers- against the law
Brothels - the business owner pays taxes to the state.
