That stinks. I hate to hear that. People have got less for murder.

Good news! The judge took off 3 years and........

Since there is no minimum non-parole peroid, when is he eligible for parole??? COuld be much sooner than we think I hope.

Hopefully, they have a system where time is knocked off for good behavior and so on. However, here in the states, I think for a crime like that, you will have to do at least 80% of your time.

The article said he was 29 yrs old. I hope he can get out early since he wasn't given a minimum non-parole period.

my guess

He will be out in 3 if he is good.

In my country you get a couple months at most
for his case.
It's sad, 10 years... are they insane????

The time he gets out depends on the way their parole system is set up.

It would be one of the three ways:

* 1/3 jail time; 1/3 remission; 1/3 parole, so a person would be out after a third of the sentence.
* Depends on the jurisdiction, the above could apply only to sentences of 6 years in total or less. For sentences above 6 years, there's no remission, so the person has to spend 2/3 of the sentence in jail.
* 1/2 jail time and 1/2 parole
* he'll most likely qualify for 6 months of work release too at the end of the jail time

Regardless, unfortunately, prisoners with such long sentences don't qualify for minimum security, regardless of the crime. He will be assesed every 6 months, probably will go to medium, and in a few years to minimum.
Unless he has connections at assesments, which hopefully he does :)

No matter what, he will be doing it hard now. Good luck to him.

man i would of fleed the country before i got my sentence.. what a waste of a mans life.. ill agree he knew what he was diong wasnt legal, however 10 years in my opinion is a little excessive.. lets hope good behavior can help the guy get out and still have some good years to live.. he should of just robbed a bank and killed the clrek he might of only gotten 8 years for that!!

later,

This is total fucking bullshit....Where would be the best place to move to get away from this piece of shit government?

Hang in there bigkiwi!

Don't move here, we here in the US would probably have it worse.

I'm always nerves about moving because I have no idea of other countries laws and regs.....not to mention all the regular shit we take for granted....

Thats one thing I have to say thats still pretty good about the USA. First time offenders still have it pretty good compared to other countries. I mean unless your crime is murder, rape, arson, kidnapping or something really bad you can usually get off with a light sentence or only probation.

Some countires are really bad like china or even worse those middle east countires where if you steal they cut off your hand. But I feel bad for kiwi. I have been to prison and know how it feels. I wish him the best and hope it all turns out ok for him.

You know after reading the article and talking to my friend in law school, I kinda understand the sentence (I dont think its right, but I see where they are comming from). I think because of the volume and the total money involved, thats what caused them to really press for a longer sentence. It does not matter where you go, if money is involved then the feds will be there to throw down. It also depends what the laws where for drug offenses. I know in states like New York the punnishment is so severe even for first time offenders with as little as two onces of a narcotic------>

In May of 1973, New York's Governor Nelson Rockefeller pushed through the state legislature a set of stringent anti-drug laws. Among the most severe in the nation, the purpose of these laws was and is to deter citizens from using or selling drugs and to punish and isolate from society those who were not deterred. "It was thought that rehabilitative efforts had failed; that the epidemic of drug abuse could be quelled only by the threat of inflexible, and therefore certain, exceptionally severe punishment."1

The new drug laws, which have since become known as the "Rockefeller Drug Laws" established mandatory prison sentences for the unlawful possession and sale of controlled substances keyed to the weight of the drug involved. Generally, the statutes require judges to impose a sentence of 15-years to life for anyone convicted of selling two ounces, or possessing four ounces of "narcotic drug" (typically cocaine or heroin).

Thats some serious shit.

Well I think the drug laws here are a bit extreme a first time offender can get 12 years depending on what and how much they are selling.

I was watching DATELINE and they had a special about drug laws...there was this HS kid that would only sell about 1gram of COKE...now that is about the same as a sugar pack...now the cops were onto him, so they set him up...they asked the guy setting him up to have him order 74 grams of coke...they knew if he sold less than 50grams, that his sentence would be only up to 4 years...since he was selling over 50 grams, his sentence would be 8to 12 years. REMEMBER this kid was only known for moving about a gram at a time...I think they targeted him because he was selling to his high school. the KID got 9 years for selling...his FIRST offense no previous record..the DATELINE special was on around election time because they were saying how BUSH's drug laws were too strict.

ANOTHER story: 25 year old black male, 2 kids and no HS education...he cannot get a job due to lack of education...well he could, but not make enough to support his wife and 2 kids...so he turns to selling crack. no previous history...he gets 12 years in prison for his crime. He also had a hand gun in his home, so that added on 5 years(I think 5 years). yeah selling is a crime, but he is in there longer than a murder, rapist, and armed robbery.
