I think it depends what substances he had. It doesn't say does it? I see the amounts but if it's anything other then weed I think he'll face some type of legal action for sure

1. MAN/DEL CS PG 2 OR 2-A >= 4G <400G This is actually a first degree felony(5-99 years) and is basically him manufacturing a caught selling a substance 4-400 grams
2. MAN/DEL CS PG 3/4 >=28G <200G This is manufacturing with intent and a Third Degree Felony, punishable between 180 days to 10 years in prison and a fine up to $10,000
3. POSS CS PG 1/1-B >=1G<4G In possesion of a controlled substance 3rd degree felony may be eligible for probation or 2-10 years in prison
4. POSS CS PG 2 >= 4G < 400G Possession of Controlled Substance, Penalty Group 2, weighing at least 4 grams but less than 400 grams. A second degree felony, if convicted, there is a potential jail time of 2-20 years in prison with a maximum fine of $10,000

Don't know why x and amphetamines are in Group 1 and 3, but you can get into a lot of "designer drugs" with this stuff

OK, so this dude is fucked. If he has no record and fully cooperates with authorities he might get drug court, or less jail time. If he does not get jail time he is a C.I. Most likely he'll plead this out to one charge and do some time. Of course there is always the lawyer getting him off on a technicality but if you are not in the court room to see that I would assume he is a CI if he is not in jail.

Regard what Fitzwater, details were murky but fentanyl was part of it. A member here with legal access looked into it a while back and it appeared the charges had gone away or least nothing was happening with them. The arrest was in September so he'd have at least had a preliminary hearing by this point if it was moving forward.

Regard what Fitzwater, details were murky but fentanyl was part of it. A member here with legal access looked into it a while back and it appeared the charges had gone away or least nothing was happening with them. The arrest was in September so he'd have at least had a preliminary hearing by this point if it was moving forward.

He probably waived the preliminary hearing if there was to be one. Preliminary hearing is just to see if they have enough evidence to go to trial. Which if its obvious its usually just waived. One would think if charges just disappeared and he is out on the street that he is a C.I. which is confidential informant and nothing to do with being a cia asset. Could have to testify against someone as well. Anyway if you live in Texas and see him about I wouldn't harass him in anyway as you'll probably wind up with more time than him. Also he was caught and charged with possession of a group 1 drug which is the class of synthetic opioids/fentanyl so that could be it.

hopefully he wasn't dealing anything like meth or opiates..

i may have mentioned before that i work at a methadone clinic - so i see firsthand how these substances ruin lives


i wouldnt be able to look at him in a positive light anymore if he was indeed trafficking these substances

Well he is off my christmas card list for this year for sure! I don't live anywhere near him and have never heard his name to my knowledge before today. If I lived near him though I wouldn't hang out with him or even talk to any of his friends. While it may not affect my life personally maybe it will for someone on the board. In fact without looking up in the thread I couldn't tell you his name now. But no I never thought about him before and I really doubt I will unless someone comes up with some juicy information. Though I see no reason why the topic can't be discussed.

A lot of percs and even Xanax are fake with fentanyl right now. So if he bought pills off the street this could be the case for fent. Also they weigh the whole pill to come up with the amount. So if he got caught with say 10 pills that weigh 5g each… this is the best case scenario for him and just speculation

I have a good friend who works in narcotics and most people would be surprised how much stuff the DA declines to prosecute. Normally they try to get the person to plea to a lesser charge but plenty just gets tossed. I would imagine in a state like Texas where they seize so much daily that what may seem like a lot in Martins case is nothing compared to the kilos they are catching from others on a daily basis.
