SORY TO BRING UP OLD POST BUT LES MILLS GYM ESPECIALLY GERRY SALMON ARE IDIOTS. I AM STILL BANNED FROM THEIR GYMS NATIONWIDE BECAUSE OF GETTING IN TROUBLE 6 YEARS AGO NOTHING TO DO WITH THE GYM WTF ?

I think they going overboard cant even give a reason , went in for train mate next day mate got called threatening him and me tresspass order ??? After all the issues Gerry Salmon has had with his staff hating him, putting gum in his hair and just plain loathing the guy you would think they would have something better to worry about.

Haven't got tresspass notice but threatened next time in there to get one. Here are the emails sent and one recieved today

I am writing this letter to make a formal complaint against Gerry
Salmon manager of Les Mills wellington. My name is Justin Rys and I
am former Mr New Zealand bodybuilding Champion as well as Current
IFBB pro bodybuilder who competes internationally against the best
in the world.I run a host of websites including BIGKIWI,
Lean-FX, a thermogenic dietary supplement for weight loss, **broken link removed** . I have recently been living
in Fiji and just arrived back in the country.

I had been a member at Les Mills for about 7 years but back in 2004
I got into trouble with the police for importing the drug fantasy
which was a legal supplement bought at health stores up until 2003.
I made a huge mistake went to jail and served my time.

Les Mill's had always supported me, sponsored me as well as me
returning the favors at events like Heart Children and helping
giving advice to other members with their training.

We went to Les Mills and had a workout the other day as a guest to
see if I wanted to join up again. My friend who we we were guests
of was called and said i was banned from all Les Mill's nationwide
and would be served a trespass notice if i went back ????? all
because i had been in trouble 6 years ago ??

This is ridiculous what sort of discrimination is this I have
always been friendly in the gym helped others and never been a
problem. There was never any wrong doing in the gym and if Gerry is
suggesting there was get him to show the proof !! If he is so
unhappy about people who have criminal records training in the gym
why are their so many people with criminal records training at Les
Mills all over the country ?? This seems more like a personal
vendetta against me.

After talking to my lawyer Chris Stevenson we are discussing taking
legal steps against Les Mills for this discrimination. Which he has
warned me will be a long drawn out process but i am more than
willing to take, it is the principle of the matter.

I may be wrong but as far as I know, most establishments reserve the right to refuse entry if they wish just like a nightclub.

For whatever reason they don't want you back there, IMO it really would be a waste of time and money to try take them to court over it.
 
I agree. I think it would be a waste of your time and energy, Justin.
It's too bad but, FUCK those guys and their gym!
 
If its a private establishment, they can decide who comes and goes. Thats how it should be. No offense.

Freedom of Association. They have the right, or should anyway, to deny access to anyone - on any grounds. That's a good thing to preserve. Imagine the courts/government forcing you to invite people you don't like to your family cookout on sunday. Of course this is hyperboli but I think it does paint a picture of what the end-game will look like when we deny private citizens, or concerns, this freedom.

As an American, I beleive in ''Freedom of Association". Basically, people have the right to deny access to a private establishment on any grounds. If I own a Golf Club and decide that I only want to extend membership to White Men of Western European decent with a proper family pedigree, that is my right. Does that pretty much make me a racist pig? Yes! HAve I just reinvented
The Country Club in Brookline MA? Yupper! Would I actually do that? As an Italian kid of Catholic faith who grew up poor and the Son of a Carpenter, absolutely NOT!!

BUT, when the government begins to make decisions effecting the membership of a private club - either through legislation or courts circumventing the law (as they often do now), it will be an icey slope. Before too long Government agents will begin showing up at your home on Sunday to make sure your cookout is attended by the appropriate number of people representing whatever the "in -vogue" protected class happens to be. You will be sued in open court because you didn't serve a hot dog to the right number of little Green people with Red hair....

Sad, but true!!! Screw this gym, other places would love to have you there
 
Its a bit different in New Zealand the human rights act in NZ means you basically cant discriminate against anyone from entering the gym if it falls under that law. here is their attached letter

Statement

Exclusion of persons from clubs
1. Les Mills is entitled to exclude persons (including existing members) from clubs any time it chooses, provided it does not exclude members based on any of the prohibited grounds for discrimination set out in the Human Rights Act 1993. Note that these grounds do not prohibit the exclusion of persons who might fall within a category addressed by them, where that exclusion is based on other grounds.
2. Where a decision is made to exclude a person from a Les Mills club, Les Mills is not obliged to give any reason for the exclusion although it might choose to do so, particularly in relation to problem conduct by the member.
3. Les Mills is required to exclude persons in situations where the health or safety of any person is at risk. This includes the health or safety of the person being considered for exclusion, and also includes issues such as harassment of other people in the club, or conduct which is dangerous.
4. Similarly, any person will be excluded from a club who engages in serious or repeated behaviour which Les Mills believes is likely to offend members.

I dunno how it is overseas but private healthclubs have the right...wheras publicly traded ones such as Bally's usually do not

Why would you want to fuck with it? Seems like a big waste of time since there are always other gyms to go to.

Les Mills represents everything that is wrong with the fitness industry. No fun having your rights dismissed. I can't stand their cookie cutter approach to everything but what do you expect, I own a gym in Austalia who wouldn't have a les mills class here if you paid me. animal eater

I'm afraid they will only fabricate a reason to enforce their ban. They will consult with their legals and come up with something which does not contravene the 1993 anti-discrimination act. Instead of getting into a protracted legal battle with them just boycott them for what you see as discrimination. Advise other to do likewise. Just be very careful of your choice of words when doing this. But since they already have a hard on for you they will not back down now. Even if they did back off and allow you to train there they will dog you out every chance they get. They really are not too clever but they do have the power to refuse entry to anyone and not state the reason. it is a no win situation unless you can absolutely prove discrimination. Sorry bro, but that is the way it is. Use your energy elsewhere is my suggestion. You are a good man and can do better elsewhere, somewhere where they will appreciate you in their gym. HAHAHAHA I too used to own gyms here in OZ I was approached by Les Mills to run programs at my gyms and I told them as long as the sun came up every morning I would never have them in my gyms. I know they are popular and make some bucks but I did not believe in them or their principles so I refused them. The opposition gym got them in and paid a truck load of money for the privilege of running those classes. All I heard was that people were getting injured from the moves and were not happy.
 
It's too bad they can't appreciate having an accomplished athlete such as yourself in their gym :confused: I would certainly be curious to know the exact reason for this type of treatment but I don't think it's worth the time, money, and effort to be involved in a legal battle....BUT if money isn't an issue and it's something that you really feel is important then let 'em have it! Are you sure there's nothing else it could be? Anyway, good luck with whatever avenue you take!!
 
Don't let it get to you, I'm surprised some one would even take the time to bring that up to you after so much time and attempt to enforce it.
