Question: Getting paid for image use/promotion work?

Since I begain training my client and I have been trying to promote her as well. She and I have been flooded with responses and I am lost at what to do next.

I know nothing about contracts or use of images, sponsorships, etc, I was just trying to get her hooked up.


She has been contacted by a Large sporting goods store and they want to use her image(s) in their advertising? How exactly does a deal like this work? Do you get paid once? Paid for a length of time for picture use? In store signings? Only free clothing?


She has also been contacted by a major supplement manufacturer and has a meeting with the owner coming up soon. How does this work if they want to use her image online and in print ads? Is this usually a contract position where you do whatever they want for a certain period of time? Do companies only offer free supplements?


I tried to search around but I couldn't find any decent information. Anyone have any links where I can look into this further?

it all depends on the gig,

the supp companys will probably want to use her for a length of time and pay her a "salary" for pics and promotional service (expos, trade shows,) they will probably offer her free supplamnets but I would try to get a cash deal every month, and depending on her position make sure it is not exclusive depending o n what kind of supps they are...

the sports store would probably want to purchase images from her, in this case she would sign the right of the selected pic over to them, or they would set up a photo shoot for her and pay her say 500 bucks for the work but thay will want the right to the pics..

the most improtant thing is to keep options open, dont go exclusive on a deal unless it is very good!

I know absolutely nothing about what your asking but I would think the both of you should have a lawyer, especially her. I wouldn't trust the supplement company's lawyer. I'm assuming that entertainment lawyers would be the best bet. They probably handle this situation.

Spend a couple of bucks and get some real legal advice. it is all to easy for big time companies to get "all over the person". That's what they do, hire serious legal muscle to work things to thier advantage, which usually means "take advantage" of your client. Good luck to her. make sure there is some thing in it for you also. It's not greed, it's fair!!

there really isnt a srtandard for compensation in these types of cases, but here are some examples

if they were to offer her 300 dollars of free supplaments every month for a year and want her to sign exclusive rights to their company( she can not endorse any other supp company) for a year in return for her as a model, she would have to take pics(at their cost, fly her out and pay expenses) they would have rights to these pics (she has no say what they do with them) . This would be a decent deal, not great by no means but for her first endorsement deal it is decent, you have to remember when you are first starting out in this biz it is all about exposure and this would be good exposure for her....

now on the other hand if she was offered a deal for a year with a check every month say 500.00 and a few hundred worth of supps each month, and they would let her pick up other sponsers (not directly competing with their products) and she would in return give them right to pics of her taken at their expense of course, and had a clause to renig at the end of the deal.. that would be something you would be stupid not to take right now...

bottom line is if she has no other offers from other supp companys something is better than nothing (deal 1) I would take what they give to you for a short peroid of time (1 year or less) and let them give her more exposure then hopefully she will have others interested in her and have some more bargaining room and good exposure under her belt... she should not have to have to pay for anything though, all flight and food, room and board for photo shoots and promotional events should be covered by them...

gettin a lawyer would be an o.k. idea but the contract at this point should not be hard to understand and you would prob pay more for the lawyer to look at it than it is worth to you... I highly doubt a supp cpmpany is going to try and pull a blanket over her head when she is just a novice in this biz and not high profile , later on down the road when the contract gets longer and more complex(stocks, % of increased profit) a lawyer would def be smart...

Normally a person who is someone's manager has a good deal of knowledge in the area of managing. I would recommend a agent in the area she works. Which would mainly be modeling for her and the manager normally is the middle man between the client and agent. Then the agent is the middle man between the manager and the person buying the manager's clients service.

Basically find the young lady a modeling agent that is good. If you find her a good one she will get a good bit more work and will have to spend less time dealing with the business side of things.

What ever the deal is make sure it is in writing. Make sure the terms are crystal clear and read the fine print. Remember the supplement company is out for themselves and the best deal for THEM! You need to be sure it is a good deal for her! Do not trust them, period. I've been in biz for myself for many years and I trust no one when it comes to money and contracts. You need to be convinced it is fair and reasonable for all.

you guys need to use your head first, befor you reccomend not trusting someone, if a company came to me and said they want to run a full page add with on of my photos I would probably do it for free right now, considering the amazing amount of exposure I would get... both those mags arevery popular and a great way to get good exposure..

if you act like an ass and want to make unreasonable demands they will put your name in the do not call list and you will never hear from them again! (bad thing) remember she dosent have any bargaining room right now, they want a picture of her, not her name.... they can find plenty of women that will give the image for free just for the exposure...

on to your question, for a photo that she owns the right to a one time fee for the purchase of the image is going to be the best for her and you, because they will want to run it longer because it will be cheaper(more exposure for her) and it will eliminate the need to get an agent involved in this deal wich will increase the amount of money you take to the bank! simple, ask them what their wiling to pay for it? and if it is a good number 500+ take it, if you want to try and get more counter offer with a bit of a larger number and see what happens... but dont be gready, they will drop you and move to the next person, she is a dime a dozen right now, she dosent have a name they are buying. they are simply purchasing the image( there are plenty of people they could get, be thankfull they want yours)

Step one:
Get her professional representation. There are tons of great agents that specialize in sports/athletic modeling and know exactly what to say/do to get her the best possible deal. They have their own lawyers on staff so it's really "one stop shopping" for your representation needs.

Step two:
See step one.

To answer the question; typically if a party wants to use photos as part of an advertising campaign then they will pay you once for the use of those photos for a set duration. Every contract contains "Exhibits" that outline the specific permissible uses of the photos that have been released, the duration for their use, and the compensation.

You can get your own entertainment lawyer, but if you sign with an agent then it's not necessary.

These are words that people should listen to, especially if they are nobodies.

There are SO many well known professional athletes (bodybuilders and other) that would do jobs like these for free just for the exposure, the only way that she will get some money is if this company hasn't been around long and hasn't realised yet that top well known people that are a dime a dozen, will do this for free.
