I can't believe the attitude on this thread...I don't care if the dude was doing the fucking Moonwalk across the street; Stallworth should not have been behind the wheel--period! It's amazing the amount of people in the USA who've had 3,4,5 DUI's and still are able to get a license. Many countries jail you after the first attempt and if you get a second DUI you never drive again.
If the USA said first DUI is a year in jail, 2nd DUI you also serve jail time and can never drive a vehicle again--how many DUI's do you think we'd see? The laws are so lax b/c of all the fines the Gvmt wants to collect.
Lets say someone breaks into your home and is robbing you; IMO if you break into someone's home you lose all rights. The homeowner can shoot you, stab you--whatever the hell he wants; b/c you lost all rights once you decided to rob him. DUI same thing. Once you get behind the wheel of a vehicle when you are drunk, the penalty should be the same. It doesn't matter if the guy was jaywalking or not. Also, Stallworth at first said the guy was lying in the street; then said he flashed his lights. If you were in a 30mph zone and saw someone crossing the street, assuming you were sober, would you: A) flash you lights and keep going, or B)Fucking stop the car!
lastly--how accurate is the testimony of a drunk going to to be anyway?
